Terms and conditions to entry:
  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entries into the promotion open on 19/04/26 and close at 11:59pm on 12/05/26 ("Promotional Period").
  3. Enter the draw to win one (1) Coffee pack. The prize consists of 1 Kensington Capsule Coffee Machine, 120 boxes of assorted Market Kitchen Coffee Pods (10 capsules per box) and 2 coffee mugs. To be eligible to enter, individuals must, during the Promotional Period:
    1. Make a purchase of any Coffee at The Warehouse (online or in-store) in a single transaction (Qualifying Transaction), excludes tea products, coffee and tea making appliances and Marketplace items. AND
    2. Scan your MarketClub QR Code when making a purchase in-store (found in The Warehouse App), OR
    3. If online (web or app) ensure you are signed into your account at the time of purchase.
    Each Qualifying Transaction will receive one automatic entry into the prize draw. No manual entry is required. To receive a Qualifying Transaction, you must have a MarketClub account. MarketClub is The Warehouse's loyalty programme.
  4. For the avoidance of doubt, customers will not be eligible to participate in this promotion if they do not scan their MarketClub QR Code in-store or are not signed in online at the time of purchase. Entries will not be accepted on a retrospective basis after the time of purchase.
  5. Available coffee brands at The Warehouse: Avalanche, Jarrah, Jeds, LOr, Market Kitchen, Moccona, Nescafe, Nestle and Starbucks. Includes all coffee types e.g. pods, sachets, bags and instant.
  6. Multiple entries are permitted, subject to the following: (a) only one (1) entry per Qualifying Transaction (regardless of the number of products purchased in that Qualifying Transaction); and (b) each entry must be submitted separately and in accordance with entry requirements.
  7. Entry is only open to New Zealand residents aged 18 years or over. Employees (and their immediate families) of The Warehouse Limited, its subsidiaries, entities and agencies associated with this promotion are ineligible to enter.
  8. The Warehouse reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity and age) and reserves the right, in its sole discretion, to disqualify any individual who The Warehouse has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at The Warehouse's discretion. Failure by The Warehouse to enforce any of its rights at any stage does not constitute a waiver of those rights. The Warehouse's legal rights to recover damages or other compensation from such an offender are reserved.
  9. The Prize draw will take place within five (5) working days of the end of the Promotional Period. The Warehouse will select the winner at random. The Warehouse's decision is final and no correspondence will be entered into.
  10. Prize notification: Winners will be contacted by The Warehouse by email or phone using the contact information associated with their The Warehouse account. If the Prize winner does not respond and redeem the prize in accordance with The Warehouse instructions within five (5) working days of first contact attempt, a new Prize winner will be drawn on the same terms as the original draw.
  11. Prize distribution: Winners contact information including full name, email address, posting address and phone number will be required to ship the prize to the winner. The prize can only be shipped within New Zealand.
  12. "Free coffee for a year" is based on approx. 3 pods per day, totaling 1200 coffee pods. Complete prize must be taken by winner at time of being awarded and winner should ensure use of pods with closer expiry dates are used first, replacement pods are not able to be supplied once the prize is accepted.
  13. Entrants consent to The Warehouse using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by The Warehouse.
  14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of The Warehouse, including but not limited to technical difficulties, unauthorised intervention or fraud, state of emergency, war, terrorism, disaster or other government action, The Warehouse reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate and at its sole discretion.
  15. For the avoidance of doubt, The Warehouse considers conduct such as purchase splitting (multiple purchases made in close succession that could reasonably have been made as a single transaction), transactional manipulation, or any pattern designed to unfairly increase entry volume, to be 'improper conduct' under these Terms and Conditions. Entries associated with such conduct may be deemed invalid at The Warehouse's discretion.
  16. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  17. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under consumer protection laws in New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, The Warehouse (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under The Warehouse's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by The Warehouse) due to any reason beyond the reasonable control of The Warehouse; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) taking of a prize.
  18. The Warehouse collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. Entry is conditional on providing this PI. The entrants consent to The Warehouse using their PI for these purposes or any other purposes set out in its Privacy Policy. The Warehouse will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://help.thewarehouse.co.nz/Help/s/article/Group-Privacy-Statement. In addition to any use that may be outlined in The Warehouse's Privacy Policy, The Warehouse may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the New Zealand Information Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of The Warehouse or its agents.
